Drink-drive ban will have ‘severe effect’ on Alford mobile hairdresser spotted travelling at 10mph with hazard lights on

A mobile hairdresser has been banned from the roads after being found behind the wheel almost three times the legal drink-drive limit.

Dionne Marshall, 52, was driving at a slow speed with her hazard lights on when she passed police officers on Sloothby High Lane on May 7.

The defendant had failed a breath test after drinking at a wake, Boston Magistrates’ Court was told.

Prosecutor Nick Kirkland said police had attended Marshall’s address after reports of her Mercedes C Class ‘swerving’, but as she was not at home they drove around the area looking for her vehicle.

“At 9.10pm on that evening the vehicle passes officers at approximately 10mph with its hazard lights on,” he added.

“The defendant was described as slurring.”

Marshall, of Sloothby Road, Willoughby, near Alford, gave a reading of 94 micrograms per 100ml of breath.

The legal limit is 35mcg.

In mitigation, Daven Naghen said a driving ban would had a ‘severe effect’ on Marshall.

“She is a mobile hairdresser, self employed,” he told the court.

“This is effectively rendering her out of work.

“She lives in a rural location where there is no public transport.

“She will have difficulty working for the foreseeable future.” Mr Naghen added:

“She had been at a funeral earlier in the day.

“This was an out-of-character misjudgement at a time she was not thinking straight.

“She drank alcohol at the wake.”

Marshall, who pleaded guilty to drink driving on Wednesday (May 28), was banned from the roads for 24 months, which could be reduced by 24 weeks if she completes the drink driver rehabilitation course.

She was also fined £330 and ordered to pay a £133 victim surcharge and £85 costs.

Marshall agreed to pay the £551 in full within 28 days.
