Spalding deli wants to hire man banned from premises
A town centre shop wants to hire a man who is currently banned from the premises.
Haiman Fatah Mohamad is not allowed to attend or have any part in the running of the Deli Super Market in Spalding’s Sheep Market, which was formerly the Hughes electrical business.
However, the current owner has requested this requirement be changed to allow Mr Mohamad to take up employment.
South Holland District Council’s licensing committee will meet to discuss the appeal on Thursday (June 5).
A representation has been received from Lincolnshire Police, although the details have been restricted.
At present, the wording of licence condition 7 of Annex 3 of the licensing agreement states: “The persons known as Haiman Fatah Mohamad and Hasan Pispar will not be permitted to attend upon the premises in any capacity and are to have no involvement whatsoever in the running of the company or the premises.”
The applicant has requested the condition be changed to read: "The person known as Hasan Pispar will not be permitted to attend upon the premises in any capacity and is to have no involvement whatsoever in the running of the company or the premises.
"Mr Haiman Fatah Mohamad will be excluded from any involvement in the ownership and/or management of the company or the premises but he is permitted to be employed on the premises under supervision."
The reasons given by the applicant says: “Mr Haiman Fatah Mohamad has fallen out of work and is known by the owners who wish to employ him to work on the premises under supervision.
“Mr Mohamad will not be left unattended at the premises or have any involvement in the management or the running of the premises.”
This variation does not amend the hours, plan or any other conditions of the current premises licence.
The police representation was not available on the council papers, although paperwork stated: “The representation can be found at (the restricted) Appendix 3 and relates to all four of the licensing objectives. The objectives are the prevention of crime and disorder, public safety, the prevention of public nuisance, and the protection of children from harm.”
