‘A clear miscalculation!’ Dogdyke pensioner ‘shocked’ to be over drink drive limit after leaving Boston pub




A ‘shocked’ pensioner was found to be over the drink-drive limit after police spotted his vehicle leaving a pub.

Michael Brown, 69, pulled out of a hostelry on Boston’s Horncastle Road at 10.30pm on June 21, a court was told.

Officers followed him to Tower Road before pulling the defendant over.

Brown, of Hawthorn Hill, Dogdyke, gave a reading of 55 micrograms of alcohol per 100ml of breath, prosecutor Nick Kirkland told Boston magistrates. The legal limit is 35mcg.

In defence Phillipa Chatterton said: “He had been to the local pub with friends and consumed alcohol.

“This was a clear miscalculation and he was shocked to find he was over the limit.

“He is a state pensioner who suffers from arthritis. He will find it difficult to use public transport.”

Brown admitted the drink-driving charge on Wednesday (July 9) and was banned from driving for 12 months, which can be reduced by 13 weeks if he completes a rehabilitation course.

He was also fined £120 and ordered to pay £85 costs and a £48 victim surcharge.
