Ban for Boston factory worker caught driving with two different drugs in system
A man found with two different drugs in his system has been banned from driving.
Mykyta Kivilevych tested positive for cannabis and methylamphetamine when police stopped his black VW Passat on Witham Place in Boston on February, as the 31-year-old was returning equipment to a mechanic.
Speaking through a Russian interpreter the factory worker pleaded guilty to both charges on Wednesday (July 9).
“The driver presented himself to officers as if being under the influence of a substance,” prosecutor Nick Kirkland told Boston magistrates, describing the incident which took place at 9.47pm.
“He had an impaired ability to communicate coherently, had glazed eyes and large pupils.
“He reported he had used cannabis earlier that day but didn’t think there was an issue as he wasn’t smoking whilst driving.”
Kivilevych, of Whitehorse lane, Boston, gave a reading of 7 micrograms of cannabis per litre of blood. The legal limit is 2mcg.
In defence, Michele Cheatle said her client ‘didn’t feel under the influence’ when he was behind the wheel.
“He had trouble with his car and a mechanic had looked at it,” she continued.
“It needed testing so he took it out to test it. He realised the testing equipment was still in his car and was taking it back to the mechanic when he was stopped.
“He said he wouldn’t have gone out if he felt under the influence and is obviously sorry for his actions.”
Chair of the bench Helen Cook told Kivilevych: “It’s not ok for you to decide whether it’s ok to drive with drugs in your system.”
Magistrates ordered the defendant return to court on August 4 to allow the probation service time to prepare a pre-sentence report.
Kivilevych was handed an interim driving ban until his next court appearance.
