Boston woman assaulted three police officers after calling for help
A woman who called for help after having her eye socket fractured ended up assaulting three police officers.
Hayley Birks said she was ‘mortified’ by the events which unfolded when she appeared at Boston Magistrates’ Court on Wednesday.
In prosecution, Turan Sunat told the court police were called to an address in Boston on October 21, where they found the defendant ‘had a facial injury, but was also intoxicated’.
Mr Sunat explained Birks (37) kicked Pc Winyard on the right thigh and bit Pc Day on the hand.
The altercation continued in the custody van where Birks bit Pc Winyard and kicked Pc Richeux twice.
“There were no injuries,” said Mr Sunat, who added that Birks had a previous convictions for assaulting a police officer dating back to in January last year.
A probation report explained Birks had been drinking at her father’s home with her brother and his friend when an argument ensued and she was left with a facial injury.
In defence, Tony Freitas explained Birks – who he described as ‘a lady who in her own words does have alcohol issues’ - had been the one who alerted the officers.
“Police attended at the request of Miss Birks. She was injured, in drink and rather upset,” he continued.
“When they ended up taking her this only exacerbated her anger.
“There were no injuries to any of the officers and she apologised at the police station.
“After visiting the hospital she discovered she had fractured her eye socket.”
The probation report added that Birks uses biting as a ‘defence mechanism’.
The 37-year-old pleaded guilty to assaulting all three officers at a previous court hearing on November 15.
“This is becoming a bit of a habit,” District Judge Peter Veits said.
“You have to look at dealing with police in a different way.”
Birks, of Puritan Way, Boston, responded by saying: “I’m sorry. I’m mortified this happened.”
She was handed a 12-month community order which included a rehabilitation requirement.
She must also pay a £114 victim surcharge and £85 costs, as well as £20 in compensation to all three police officers.
