Kirton driver twice legal alcohol limit swerved car into ditch at Cowbit after being asked to stay late at work




A man who drank cans of lager after being asked to stay late at work ended up swerving his car into a ditch.

Jody Creek was more than twice the legal drink-drive limit when the incident involving his Ford Fiesta occurred at on Mill Drove South, Cowbit, on Friday, October 11.

The Kirton resident pleaded guilty to drink driving when he appeared at Boston Magistrates’ Court on Wednesday, where he received a 20-month driving ban.

Defending the 39-year-old, Philippa Chatterton said Creek was asked to stay late at work to secure the site after a delivery.

“His Friday routine is that, at dinner time, he goes to the shop and buys lager to drink that night and help him relax after a long week at work,” she added.

“He was waiting for some time and then a song came on the radio that reminded him of his father, who had passed away and he was close to.

“He heard the song and reached for a can of lager and drank it. He had two cans.

“When he was driving home a vehicle came from the opposite direction across his side of the road. He swerved to avoid the vehicle and ended up in the ditch.”

Miss Chatterton added her client - who she described as devastated’ to appear in court - would lose his job as a ground worker as a result of no longer having his licence.

Creek, of Birch Road, gave a reading of 78 micrograms of alcohol per 100ml of breath. The legal limit is 35mcg.

“At around 7pm police were called to a vehicle in a ditch,” prosecutor Lottie Tyler told Boston Magistrates’ Court on Wednesday.

“The caller stated they had seen a male leave the vehicle with a cigarette.

“When they arrived a recovery vehicle had started to recover the vehicle.”

On top of his ban, which could be reduced by 20 weeks if he completes the drink-driver rehabilitation course, Creek was fined £120 and ordered to pay £85 costs and the £45 victim surcharge.
