Spalding Sultan Kebab & Pizza shop not allowed to extend opening hours




A town centre kebab shop will not be allowed to extend its opening hours after council planners ruled the proposal was ‘unacceptable’.

Sultan Kebab and Pizza in New Road, Spalding, wanted permission to be able to open from 1pm until 3am, every day – but has been refused by South Holland District Council.

Applicant Asty Mustafa said that the move is due to a ‘lack of business at the existing time’.

The shop – which has a house in multiple occupation (HMO) on the top two floors – currently opens from 8am to 11pm Monday to Saturday and 8am to 10pm on Sundays and Bank Holidays. It needed an appeal to win planning permission to open in 2019, with the site having previously been a phone repair shop.

A report drawn up by the district council’s planning team said that nearby bars are open until midnight on weekdays and 1am at the weekend.

It says Hot and Spicy – opposite the site – opens from 4.30pm to 1am Monday to Thursday and 4.30pm to 3am on Fridays and Saturdays – but says that no business currently operates as late as the proposal in the week or on Sundays.

The report stated: “The potential impacts here would be felt particularly poignantly due to the presence of the density of dwellings in the area and the residences above the shop.

“The noise and other biproducts of operating the business at these late hours would impact upon the amenity of the nearby residents, reducing their quality of life.

“The proposed opening hours would be more acceptable if they were restricted solely to Fridays and Saturdays, were it is accepted that noise levels will be greater for longer.”

Officers ruled that the opening hours were ‘unacceptable’ due to the ‘potential pollution’ from increased noise and refused the plan.
