Spalding man without full driving licence crashed when over drink drive limit
A man who took his partner’s car before colliding into a bollard has been banned from the roads after admitting to driving while over the legal alcohol limit.
Fabio Santos only holds a provisional driving licence.
However, he got behind the wheel following an argument, a court was told.
Thirty-seven-year-old Santos admitted driving with excess alcohol and without a full driving licence or insurance, when he appeared at Boston Magistrates Court on Wednesday.
Prosecuting, Marie Stace said police attended a single vehicle collision in West Elloe Avenue, Spalding at 1.20am on November 20.
Ms Stace added an Audi car had collided with a bollard and finished up partially on the kerb.
She said the car belonged to Santos’ partner and at the scene it was established her partner, Santos, had taken the car following an argument.
Santos came to the scene and admitted he had been driving and had lost control of the car.
He was arrested following a positive breath test.
A later reading showed Santos had 78 micrograms of alcohol in his breath.
The legal limit is 35mcg.
In defence, Helen Coney said Santos had a provisional driving licence and there was insurance for him to drive.
However, this had been invalidated because he did not have L plates on the car and he was not accompanied by a supervising driver when he set off.
Santos, of Lilburn Drive, Spalding, was banned from driving for 20 months.
However, he was offered the drink drivers’ rehabilitation course.
This course will reduce the period of the ban by 20 weeks.
Santos was also fined £346 and ordered to pay a total of £223 in court costs and charges.
