Prison warning for Bicker man unless he pays child support

A man has been warned he could face prison if he misses another instalment of child support.

Lloyd Michael Ogilvie pleaded guilty to missing maintenance payments when he appeared before Boston magistrates on Monday.

In prosecution, Darren Newberry told the court the defendant had previously reached ‘total arrears of £10,415.12’. He added that Ogilvie (32), had received two liability orders made by Nottingham Magistrates’ Court - one for £1,186.27 in August 2019 and a second for £5,590.44 in July 2021.

However, the defendant did make a payment of £500 in January, the court was told.

“Mr Ogilvie has previously refused to engage with the CMS (Child Maintenance Service),” Mr Newberry said. “We had no responses.

“But there has been positive conversations and he has suggested paying £400 per month to cover unpaid maintenance. This is acceptable to the CMS.

Ogilvie, of Bishop Way, Bicker, appeared under warrant.

Defending him, Carrie Simpson said: “He accepts culpable neglect. There were times he was not seeing the child so thought ‘why should I pay?’

“But the payment made in January should convince you his intentions are good.”

Miss Simpson told the court Ogilvie, a joiner, could afford to pay £400 per month to begin covering the arrears.

Magistrate Robert Skinner said: “You accept that you owe a backlog of money and have ongoing £58.06 per week (in payments), but have offered to pay £400 per month going forward.

“Having paid £500 it does seem you have made a step forward, but you have been culpable in neglect.”

Ogilvie received a suspended committal, meaning he could be jailed for 42 days if he misses another payment. He was also ordered to pay £41 costs.
