Holbeach legal firm Mossop and Bowser are giving advice on boundary disputes

Have you been approached by you neighbour about the position of a boundary feature? Have you concerns about where your neighbour is putting up a fence or if they are claiming and using your land? If you answer yes to any of these questions you may wish to understand where your boundary lines are for your property.

Once a boundary feature is changed or replaced or a new neighbour moves in, it is not uncommon for a disagreement to start over where the boundary line is and who has responsibility for repairs.

Your neighbour may take matters into their own hands and replace a boundary feature but in doing so they may put the feature on your land taking away some of what you believe to be your property.

The deeds to a property help indicate where the boundary should lie. However, deeds are not always easy to interpret and there are in fact many instances where there are errors in the deeds which makes determining the boundary line difficult.

If a boundary dispute gets to the stage where court or tribunal proceedings are required, the legal costs can be substantial and could be in the region of £25,000.

In order to try to avoid such legal costs it is best to get advice at an early stage before you move or replace a boundary feature or if there is any doubt as to where it should be. Mossop & Bowser can inspect the documents that are available for your property and give you helpful advice which we hope will facilitate a quick and amicable solution to the boundary issue. In addition, if it becomes clear that there are some problems which need to be addressed we are able to provide you with a clear plan on the steps to take to find a suitable and efficient solution to the issues you have.
