Fines for Spalding man who twice breached restraining order




A Spalding man who twice broke the terms of a court restraining order and harassed his estranged wife has been fined £30 for each of the breaches after magistrates heard he was now working with agencies to deal with his alcohol problems.

Michael Herbert (56), of Cross Street, Spalding, admitted the two charges when he appeared at Boston

Magistrates' Court.

The court heard that on May 16 he sent text messages to his wife saying he missed her and asking her to

give him a chance, and at 6.24pm, she telephoned the police to say that he had come to her home

and had locked himself in a shed after a third party had locked him out of the house.

On May 25 at 5.30pm, he was again outside the house and broke a window at the rear of the house before police arrived and arrested him.

He told police he had wanted to speak to his wife but she would not let him in so he had broken a window to get her attention.

Prosecuting, Marie Stace said a restraining order had been imposed on Herbert following an assault conviction in April.

Michael Alexander, mitigating, said Herbert and his wife had had a 20 year relationship and he had not been able to get into his head that there was a problem, as they had been talking and 'he thought they were going to be OK', whereas she was telling him the relationship was over and he needed to sort himself out.

He said Herbert had an alcohol problem and had been to different agencies and could now see that the relationship had broken down.

The Probation Service told the magistrates that Herbert was attending Alcoholics Anonymous and was also attending rehabilitation days as part of the community order he was serving from his April sentence.

The magistrates said they were 'very pleased' he was complying with Probation and that the restraining order and the community order would continue.

Herbert must pay a total of £60 in fines and a £30 charge.
