Development of 62 homes at Braunston Road, Oakham, will go ahead despite demise of Rutland Local Plan
More than 60 new homes will be built as planned - despite a council's decision to withdraw a document outlining the future of local development.
Rutland County Council’s planning committee had voted, back in July, to allow 62 homes to be constructed off Braunston Road, Oakham.
The full council later decided to withdraw the county's draft Local Plan, which would have guided future developments such as this one.
This prompted the chairman of the planning committee to request that planning approval for the Braunston Road development be reconsidered, if this was lawful and possible.
It was due to be reconsidered at a meeting on Monday, October 4.
Having sought legal advice, the committee has been told the Braunston Road application cannot lawfully be reconsidered.
This, it was informed, was for two reasons - because the need for this site remains to deliver help meet the requirement for a five-year housing land supply as required by the National Planning Policy Framework, and because the site’s suitability was demonstrated in the Local Plan before it was withdrawn and when the planning application was assessed.
As a result, the decision to grant planning permission for the Braunston Road development will not be reconsidered.
